Clear expectations for
using our technology.

These Terms govern your access to and use of Koneth websites, applications, trading technology, developer services, and other products.

By accessing or using Koneth, you agree to these Terms. If you do not agree, you should not use the applicable Koneth services.

Important

Koneth provides technology infrastructure. Trading businesses using Koneth operate independently and may apply their own additional terms, rules, and conditions.

What Koneth provides

Koneth develops and provides technology for trading businesses, developers and traders. Our products and services may include:

  • Web, desktop and mobile trading applications

  • Indicators

Specific products may be governed by additional terms.

Koneth is a technology provider

Koneth provides software and technology infrastructure.

Koneth is not a broker, dealer, investment adviser, investment manager, exchange, bank, custodian or financial institution.

Koneth does not:

  • Accept deposits for trading on its own behalf
  • Operate brokerage accounts for traders
  • Act as counterparty to your trades merely because Koneth technology processes them
  • Provide personalized investment advice
  • Recommend that you buy or sell financial instruments
  • Guarantee trading results
  • Manage customer funds on behalf of businesses using Koneth technology

Trading accounts accessible through Koneth may be provided and operated by independent brokers, prop firms or other organizations.

Your relationship with such an organization is separate from your relationship with Koneth.

Businesses using Koneth

Organizations may use Koneth technology to operate their own trading products and services. These organizations may independently determine matters including:

  • Account eligibility
  • Account sizes
  • Trading conditions
  • Leverage
  • Spreads and commissions
  • Markets and instruments
  • Evaluation requirements
  • Drawdown rules
  • Profit targets
  • Account restrictions
  • Pricing
  • Payments
  • Withdrawals or payouts
  • Customer support
  • Account suspension or termination

Unless expressly stated otherwise, these decisions are made by the organization providing your trading account and not by Koneth.

Questions or disputes concerning an organization’s business rules, payments, payouts or customer relationship should generally be directed to that organization.

Eligibility

You must be legally capable of entering into an agreement with Koneth to use services requiring an account.

Certain Koneth services may have additional eligibility requirements.

Organizations using Koneth technology may establish separate eligibility requirements for their own users.

You are responsible for ensuring that your use of Koneth is lawful in the jurisdiction applicable to you.

Your Koneth account

Some services may require a Koneth account or other credentials.

You agree to provide accurate information where required and keep applicable information reasonably current.

You are responsible for protecting:

  • Passwords
  • Trading credentials
  • API keys
  • Access tokens
  • Recovery information
  • Other authentication credentials

You must not intentionally provide another person with credentials where doing so would violate these Terms, applicable product rules or the terms of the organization providing your account.

Notify us promptly if you believe your Koneth account or credentials have been compromised.

Trading accounts

A trading account displayed or accessed through Koneth Trader may belong to or be administered by a third-party organization.

Koneth may provide the technology used to authenticate the account, process trading instructions, calculate or display account information and communicate with the relevant trading infrastructure.

This does not mean Koneth operates the business providing that account.

The relevant organization’s terms may apply separately.

Trading risk

Trading involves risk.

Financial markets can move rapidly, and losses may occur.

Technology, automated strategies, indicators, analytics and other tools cannot eliminate trading risk or guarantee future performance.

Historical performance does not guarantee future results.

You are responsible for understanding the products and services you use and the risks associated with your trading activity.

Nothing provided by Koneth constitutes personalized investment, financial, legal or tax advice.

Simulated trading

Some environments accessible through Koneth may involve simulated trading rather than transactions executed on an external financial market.

This may include prop-firm evaluations, demonstration accounts, testing environments and other simulated trading products.

The organization providing the environment is responsible for explaining the nature of its product to its users.

Koneth’s provision of the underlying technology does not itself mean that a transaction has been executed on a live financial market.

Markets and instruments

Koneth technology may support traditional, synthetic, proprietary or custom markets.

Pricing may originate from Koneth customers, market-data providers, liquidity providers or other sources depending on the trading environment.

The availability of an instrument through Koneth does not constitute an endorsement or investment recommendation.

Different organizations may offer different:

  • Symbols
  • Prices
  • Spreads
  • Trading sessions
  • Contract specifications
  • Execution models
  • Margin requirements
  • Market conditions

Users should refer to the organization providing their trading environment for the specifications applicable to their account.

Synthetic and proprietary markets

Businesses may use Koneth technology to provide proprietary or synthetic instruments.

Synthetic instruments may be generated through models or pricing systems and may not correspond directly to an externally traded underlying financial instrument.

Where a third-party organization operates such a market, that organization is responsible for its pricing methodology, disclosures, rules and legal obligations.

Koneth may provide technology used to build, distribute or operate such markets without becoming the operator of the customer’s underlying trading business.

Automated trading and KAS

Koneth may allow automated trading through Koneth Automated Strategies (KAS) and other supported technologies.

Automated strategies can produce unexpected results and may execute trading actions without manual confirmation.

You are responsible for:

  • Reviewing strategies before using them
  • Understanding their configuration
  • Selecting appropriate permissions
  • Monitoring their operation where appropriate
  • Understanding the risks associated with automated trading

Koneth does not guarantee the performance, profitability, reliability or suitability of any strategy.

Indicators, tools and plugins

Koneth may allow users or developers to create, install, distribute or use:

  • Indicators
  • Tools
  • Plugins
  • Strategies
  • Integrations
  • Other extensions

Some extensions may be provided by independent third-party developers.

Third-party content is the responsibility of its publisher and may be subject to additional terms.

Availability through Koneth does not necessarily mean that Koneth created, endorses or guarantees that content.

Koneth may restrict or remove extensions where reasonably necessary for security, legal, technical or policy reasons.

Koneth Automations

Koneth Automations allow organizations to configure actions based on account, trading or other data.

The organization using an Automation determines its configuration, including relevant conditions, thresholds and actions.

For example, an organization may configure an Automation to disable an account when a specified condition is detected.

Koneth provides the automation technology but does not independently determine the business rules selected by the organization.

Developer services

Koneth may provide APIs, SDKs, documentation, development environments and other developer technology.

Developers must:

  • Protect API credentials
  • Follow applicable documentation
  • Respect rate limits
  • Request only authorized data
  • Maintain appropriate security
  • Avoid interfering with Koneth infrastructure
  • Comply with applicable laws and additional developer terms

We may modify APIs as our platform evolves.

Where reasonably practical, we may provide documentation or notice regarding material changes.

Separate Developer Terms may apply.

API restrictions

You must not use Koneth APIs to:

  • Gain unauthorized access
  • Circumvent permissions
  • Extract data you are not authorized to access
  • Overload or disrupt our infrastructure
  • Probe systems for malicious purposes
  • Distribute malicious software
  • Conceal abusive activity
  • Violate applicable law
  • Interfere with another user’s services

Koneth may apply rate limits and other technical safeguards.

Marketplace and developer content

Koneth may provide functionality allowing developers to distribute strategies, indicators, tools, plugins or other products.

Publishers remain responsible for content they distribute.

Separate Marketplace or Publisher Terms may govern matters such as:

  • Publishing requirements
  • Intellectual property
  • Security
  • Licensing
  • Pricing
  • Revenue sharing
  • Refunds
  • Content removal
  • Developer responsibilities

Intellectual property

Koneth and its associated software, branding, interfaces, documentation, designs, technology and other materials are protected by applicable intellectual-property laws.

Except where expressly permitted, you may not:

  • Copy Koneth software
  • Reverse engineer protected components
  • Reproduce proprietary interfaces or assets
  • Remove copyright or trademark notices
  • Misrepresent Koneth technology as your own
  • Use Koneth trademarks without authorization
  • Resell services where resale is not permitted

Rights not expressly granted remain reserved.

Your content

Where Koneth allows you to upload, publish or submit content, you retain ownership of rights you hold in that content.

You grant Koneth the permissions reasonably necessary to host, process, display, transmit and otherwise handle that content for the purpose of providing the relevant service.

You must have the rights necessary to submit content to Koneth.

Feedback

If you voluntarily provide ideas, suggestions or feedback about Koneth, we may use that feedback to develop and improve our products without an obligation to compensate you, unless otherwise agreed in writing.

Third-party services

Koneth may integrate with third-party services, including market-data providers, infrastructure providers, business systems and developer applications.

Third-party services may be subject to separate terms and policies.

We are not responsible for independent third-party services except to the extent required by applicable law or expressly agreed otherwise.

Availability and changes

We work to provide reliable technology, but no software or online service can be guaranteed to operate without interruption.

Koneth services may occasionally be unavailable because of:

  • Maintenance
  • Updates
  • Infrastructure failures
  • Network issues
  • Third-party failures
  • Security incidents
  • Events outside our reasonable control

We may add, modify or discontinue features as the platform evolves.

Specific availability commitments made to business customers will be governed by their applicable Business Agreement or Service Level Agreement.

Prohibited use

You must not use Koneth to:

  • Break applicable laws
  • Gain unauthorized access to systems or accounts
  • Distribute malware
  • Attack or disrupt infrastructure
  • Circumvent security controls
  • Abuse APIs or services
  • Misrepresent your relationship with Koneth
  • Infringe intellectual-property rights
  • Facilitate fraudulent activity
  • Use Koneth in a way that materially harms other users or our infrastructure

Additional restrictions may appear in our Acceptable Use Policy.

Suspension and termination

We may restrict, suspend or terminate access where reasonably necessary because of:

  • Material violation of these Terms
  • Security threats
  • Fraud or abuse
  • Unauthorized access
  • Legal requirements
  • Non-payment where applicable
  • Material risk to Koneth or other users

Where appropriate and reasonably practicable, we may provide notice or an opportunity to resolve the issue.

You may stop using Koneth at any time, subject to any separate contractual commitments.

Privacy

Our Privacy Policy explains how Koneth processes personal information.

Organizations using Koneth may also maintain their own privacy policies governing their relationship with their customers.

Disclaimers

To the extent permitted by applicable law, Koneth services are provided on an “as available” basis.

We do not guarantee:

  • Trading profits
  • Investment performance
  • Continuous market availability
  • The profitability of automated strategies
  • The accuracy of third-party content
  • That every third-party integration will remain available
  • That services will operate without interruption or error

Nothing in these Terms excludes rights or protections that cannot lawfully be excluded.

Limitation of liability

Nothing in these Terms limits or excludes liability where doing so would be unlawful, including liability that cannot be excluded under applicable law.

Subject to applicable law, Koneth will not be responsible for indirect or consequential losses arising from use of the services where such losses were not reasonably foreseeable or where responsibility properly lies with an independent third party.

Different liability provisions may apply to organizations purchasing Koneth business services and will be set out in their applicable Business Agreement.

Changes to these Terms

We may update these Terms as Koneth, our services or applicable requirements evolve.

The latest version will be published on this page with an updated revision date.

Where appropriate, we may provide additional notice of material changes.

Continued use of the relevant services following the effective date of updated Terms constitutes acceptance where permitted by applicable law.

Governing law

These Terms are governed by the laws of England and Wales, subject to any mandatory rights that may apply under applicable law.

The courts of England and Wales will have jurisdiction over disputes arising from these Terms, except where applicable law provides otherwise.
